Does it matter if I was not wearing a helmet?

Mississippi does not require all adult riders to wear helmets. Even if you were not wearing one, you can still pursue a claim. The insurance company may argue that a helmet would have reduced your injuries, but that does not eliminate the other driver's responsibility for causing the accident.
